An Act

 

amending title 15, chapter 7, article 1, Arizona Revised Statutes, by adding section 15-701.04; relating to school instruction.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 15, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 15-701.04, to read:

START_STATUTE15-701.04. Internet safety instruction; resources; parental opt out

A. beginning in the 2024-2025 school year, The state board of education shall include in the minimum course of study prescribed pursuant to sections 15-701 and 15-701.01 a requirement that students in each of grades five through twelve receive internet safety instruction.  The instruction provided pursuant to this subsection shall include best practices for all of the following:

1. Protecting students from opioids, including fentanyl.

2. Protecting students from online predators.

3. Safe online communication, including communication on platforms that are related to online games.

4. Protecting students' privacy, personal safety and other cyber security interests while using applications on a phone or computer.

B. On or before June 30, 2025, the department of education shall compile age-appropriate resources that satisfy the requirements prescribed in subsection A of this section and make the resources available to school districts and charter schools.

C. A school district or charter school may satisfy the instruction requirement prescribed in subsection A of this section by using either:

1. Age-appropriate resources that satisfy all of the requirements prescribed in subsection A of this section and that the department makes available pursuant to subsection B of this section.

2. Training provided by a county attorney's office in this state, a state agency or a federal agency.

D. Notwithstanding subsection A of this section, a student is not required to receive internet safety instruction pursuant to this section if the student's parent opts the student out of the instruction requirement. Each school district and charter school that provides instruction pursuant to this section shall provide each student's parents with an opportunity to opt the student out of the instruction requirement.
