    1                        A bill to be entitled                      
    2         An act relating to assisted living facilities;
    3         amending s. 429.178, F.S.; removing a provision that
    4         exempts an assisted living facility that provides
    5         special care for persons with Alzheimer’s disease or
    6         other related disorders from the requirement to pay
    7         for certain training and education programs; providing
    8         an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (8) of section 429.178, Florida
   13  Statutes, is renumbered as subsection (7), and present
   14  subsection (8) of that section is amended to read:
   15         429.178 Special care for persons with Alzheimer’s disease
   16  or other related disorders.—
   17         (7) Any facility more than 90 percent of whose residents
   18  receive monthly optional supplementation payments is not
   19  required to pay for the training and education programs required
   20  under this section. A facility that has one or more such
   21  residents shall pay a reduced fee that is proportional to the
   22  percentage of such residents in the facility. A facility that
   23  does not have any residents who receive monthly optional
   24  supplementation payments must pay a reasonable fee, as
   25  established by the department, for such training and education
   26  programs.
   27         Section 2. This act shall take effect July 1, 2011.
