A BILL FOR AN ACT

 

 

relating to shopping carts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that abandoned shopping carts are a nuisance to businesses and establishments, customers, property owners, police departments and other law enforcement agencies, and the public, especially on Oahu.  Shopping carts are stolen and then discarded, strewn, and abandoned in communities across Oahu, with carts being left in beach parks and on sidewalks and roadways or abandoned in brush and streams, near bus stops, and at people's homes.  Shopping carts that lie abandoned on sidewalks, roadways, and throughout communities jeopardize the safety of pedestrians who must walk on the street to avoid the carts and drivers who must navigate around the carts.

     The legislature further finds that shopping carts become rusty, dirty, and damaged when left exposed to the natural elements and often contain abandoned or discarded items or trash that also pose health and safety hazards.  Abandoned shopping carts are also an eyesore and blight to the environment.

     The legislature additionally finds that working with businesses and other establishments that own or lease shopping carts and other stakeholders to develop a regulatory system for shopping carts will help address the issue of abandoned shopping carts.

     Accordingly, the purpose of this Act is to establish a shopping cart task force to develop a system of regulatory controls for shopping carts.

     SECTION 2.  (a)  There is established within the governor's office a shopping cart task force to develop a system of regulatory controls for shopping carts.

     (b)  The task force shall consist of:

     (1)  The governor's coordinator on homelessness, who shall serve as the chair of the task force;

     (2)  The attorney general, or the attorney general's designee;

     (3)  A representative from the senate, to be appointed by the president of the senate;

     (4)  A representative from the house of representatives, to be appointed by the speaker of the house of representatives;

     (5)  A representative from the office of the mayor of the city and county of Honolulu; and

     (6)  A representative of the Honolulu police department, to be appointed by the chief of police of the Honolulu police department.

     (c)  The chair of the task force shall invite a representative of the Retail Merchants of Hawaii and any other members, including representatives from state agencies, stakeholders, or advocates, as recommended by a majority of the task force to become members of the task force.

     (d)  Members of the task force shall serve without compensation but may be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (e)  As part of its duties, the task force shall consider regulations for the control of shopping carts that:

     (1)  Prevent the unauthorized removal of shopping carts from business establishments;

     (2)  Provide for the prompt retrieval of shopping carts when the shopping carts are lost, stolen ,or abandoned; and

     (3)  Prevent the continued possession of unlawfully removed shopping carts and the accumulation of shopping carts on publicly or privately owned property.

     (f)  The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     (g)  The task force shall cease to exist on June 30, 2025.

     SECTION 3.  This Act shall take effect upon its approval.
