A BILL FOR AN ACT

 

 

relating to home health agencies.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321-     Home health agencies; complaint registry.  (a)  The department of health shall establish and maintain a complaint registry that contains a record of all complaints filed with the department against home health agencies licensed by the State.

     (b)  The department shall make the registry available for public access on the office of health care assurance's website.

     (c)  The department of health shall adopt rules pursuant to chapter 91 to implement this section.

     (d)  As used in this section, "home health agency" means a public or proprietary agency, a private nonprofit organization, or a subdivision of the agency or organization that is primarily engaged in providing direct or indirect skilled nursing services and other therapeutic services under a physician's direction to homebound patients on a part-time or intermittent basis in a place used as the individual's home."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
