HOUSE RESOLUTION

 

 

requesting the department of health to conduct a study to identify the number of fraudulent clean and sober homes in the state.

 

 

 

     WHEREAS, a clean and sober home is a small group living space for persons recovering from alcohol and substance abuse; and

 

     WHEREAS, clean and sober homes are a critical strategy to assist an individual's recovery from substance use disorders by providing a stable independent environment free of alcohol and drugs to support and sustain the recovery process; and

 

     WHEREAS, however, there is a concern that some operators of clean and sober homes take in clients but do not provide adequate services to the client, or sometimes do not provide any services to the client, despite billing the client's insurance provider for these services; and

 

     WHEREAS, there is a further concern that residents of these fraudulent clean and sober homes then leave the clean and sober home, either voluntarily or because they have been forced out, and become homeless; and

 

     WHEREAS, fraudulent operators of clean and sober homes pose a serious risk to persons recovering from substance abuse and can negatively impact the communities in which these homes are located; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2024, that the Department of Health is requested to conduct a study to identify the number of fraudulent clean and sober homes in the State; and

 

     BE IT FURTHER RESOLVED that as part of the study the Department of Health is requested to identify how fraudulent clean and sober homes contribute to the homeless crisis faced by the State; and

 

     BE IT FURTHER RESOLVED that the Department of Health is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2025; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Director of Health.
