H.F. 2202 Section 1. HOME AND COMMUNITY-BASED SERVICES WAIVER 1 SERVICES —— LEGALLY RESPONSIBLE INDIVIDUALS —— FAMILY 2 CAREGIVERS —— PAID PROVIDERS OF PERSONAL CARE SERVICES. The 3 department of health and human services shall submit a waiver 4 amendment request to the centers for Medicare and Medicaid 5 services of the United States department of health and 6 human services for approval to incorporate into the state’s 7 home and community-based services 1915(c) waivers, on an 8 ongoing basis, the flexibilities applicable under Appendix 9 K during the COVID-19 public health emergency that allow, 10 to the maximum extent authorized under federal law, legally 11 responsible individuals and family caregivers, including 12 legal guardians and other relatives who are not legally 13 responsible individuals, to be paid providers for the purposes 14 of delivering supported community living, consumer-directed 15 attendant care, or consumer choices option personal care 16 services. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill requires the department of health and human 21 services to submit a waiver amendment request to the centers 22 for Medicare and Medicaid services of the United States 23 department of health and human services for approval to 24 incorporate into the state’s home and community-based services 25 1915(c) waivers, on an ongoing basis, the flexibilities 26 applicable under Appendix K during the COVID-19 public health 27 emergency that allow, to the maximum extent authorized under 28 federal law, legally responsible individuals and family 29 caregivers to be paid providers for the purposes of delivering 30 supported community living, consumer-directed attendant care, 31 or consumer choices option personal care services. 32 -1- LSB 5188YH (4) 90 pf/ko 1/ 1
