Bill Title: Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall require and conduct a program to train EMS personnel to access a cell phone's medical identification or medical information application. Requires the Department to adopt rules to implement the provisions. Provides that EMS personnel may not be charged any fee for training required under the provisions and may not be required to complete the training until at least 6 months after adoption of rules under the provisions. Amends the Illinois State Police Law of the Civil Administrative Code of Illinois and the Illinois Police Training Act requiring similar training of Illinois State Police officers and law enforcement officers, but allows the Illinois State Police and the Illinois Law Enforcement Training Standards Board to develop a training program based upon the Department of Public Health's training program. Effective January 1, 2025.

1 AN ACT concerning government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-711 as follows:
7 (20 ILCS 2310/2310-711 new)
8 Sec. 2310-711. Training; cell phone medical information.
9The Department shall require and approve a program to train
10EMS personnel, as that term is defined in Section 3.5 of the
11Emergency Medical Services (EMS) Systems Act, to access a cell
12phone's medical identification or medical information
13application. The Department shall adopt rules to implement
14this Section. EMS personnel may not be charged any fee for
15training required under this Section and may not be required
16to complete the training until at least 6 months after
17adoption of rules under this Section.
18 Section 10. The Illinois State Police Law of the Civil
19Administrative Code of Illinois is amended by changing Section
202605-51 as follows:

1 Sec. 2605-51. Division of the Academy and Training.
2 (a) The Division of the Academy and Training shall
3exercise, but not be limited to, the following functions:
4 (1) Oversee and operate the Illinois State Police
5 Training Academy.
6 (2) Train and prepare new officers for a career in law
7 enforcement, with innovative, quality training and
8 educational practices.
9 (3) Offer continuing training and educational programs
10 for Illinois State Police employees.
11 (4) Oversee the Illinois State Police's recruitment
12 initiatives.
13 (5) Oversee and operate the Illinois State Police's
14 quartermaster.
15 (6) Duties assigned to the Illinois State Police in
16 Article 5, Chapter 11 of the Illinois Vehicle Code
17 concerning testing and training officers on the detection
18 of impaired driving.
19 (7) Duties assigned to the Illinois State Police in
20 Article 108B of the Code of Criminal Procedure.
21 (a-5) Successful completion of the Illinois State Police
22Academy satisfies the minimum standards pursuant to
23subsections (a), (b), and (d) of Section 7 of the Illinois
24Police Training Act and exempts State police officers from the
25Illinois Law Enforcement Training Standards Board's State
26Comprehensive Examination and Equivalency Examination.

1Satisfactory completion shall be evidenced by a commission or
2certificate issued to the officer.
3 (b) The Division of the Academy and Training shall
4exercise the rights, powers, and duties vested in the former
5Division of State Troopers by Section 17 of the Illinois State
6Police Act.
7 (c) Specialized training.
8 (1) Training; cultural diversity. The Division of the
9 Academy and Training shall provide training and continuing
10 education to State police officers concerning cultural
11 diversity, including sensitivity toward racial and ethnic
12 differences. This training and continuing education shall
13 include, but not be limited to, an emphasis on the fact
14 that the primary purpose of enforcement of the Illinois
15 Vehicle Code is safety and equal and uniform enforcement
16 under the law.
17 (2) Training; death and homicide investigations. The
18 Division of the Academy and Training shall provide
19 training in death and homicide investigation for State
20 police officers. Only State police officers who
21 successfully complete the training may be assigned as lead
22 investigators in death and homicide investigations.
23 Satisfactory completion of the training shall be evidenced
24 by a certificate issued to the officer by the Division of
25 the Academy and Training. The Director shall develop a
26 process for waiver applications for officers whose prior

1 training and experience as homicide investigators may
2 qualify them for a waiver. The Director may issue a
3 waiver, at his or her discretion, based solely on the
4 prior training and experience of an officer as a homicide
5 investigator.
6 (A) The Division shall require all homicide
7 investigator training to include instruction on
8 victim-centered, trauma-informed investigation. This
9 training must be implemented by July 1, 2023.
10 (B) The Division shall cooperate with the Division
11 of Criminal Investigation to develop a model
12 curriculum on victim-centered, trauma-informed
13 investigation. This curriculum must be implemented by
14 July 1, 2023.
15 (3) Training; police dog training standards. All
16 police dogs used by the Illinois State Police for drug
17 enforcement purposes pursuant to the Cannabis Control Act,
18 the Illinois Controlled Substances Act, and the
19 Methamphetamine Control and Community Protection Act shall
20 be trained by programs that meet the certification
21 requirements set by the Director or the Director's
22 designee. Satisfactory completion of the training shall be
23 evidenced by a certificate issued by the Division of the
24 Academy and Training.
25 (4) Training; post-traumatic stress disorder. The
26 Division of the Academy and Training shall conduct or

1 approve a training program in post-traumatic stress
2 disorder for State police officers. The purpose of that
3 training shall be to equip State police officers to
4 identify the symptoms of post-traumatic stress disorder
5 and to respond appropriately to individuals exhibiting
6 those symptoms.
7 (5) Training; opioid antagonists. The Division of the
8 Academy and Training shall conduct or approve a training
9 program for State police officers in the administration of
10 opioid antagonists as defined in paragraph (1) of
11 subsection (e) of Section 5-23 of the Substance Use
12 Disorder Act that is in accordance with that Section. As
13 used in this Section, "State police officers" includes
14 full-time or part-time State police officers,
15 investigators, and any other employee of the Illinois
16 State Police exercising the powers of a peace officer.
17 (6) Training; sexual assault and sexual abuse.
18 (A) Every 3 years, the Division of the Academy and
19 Training shall present in-service training on sexual
20 assault and sexual abuse response and report writing
21 training requirements, including, but not limited to,
22 the following:
23 (i) recognizing the symptoms of trauma;
24 (ii) understanding the role trauma has played
25 in a victim's life;
26 (iii) responding to the needs and concerns of

1 a victim;
2 (iv) delivering services in a compassionate,
3 sensitive, and nonjudgmental manner;
4 (v) interviewing techniques in accordance with
5 the curriculum standards in this paragraph (6);
6 (vi) understanding cultural perceptions and
7 common myths of sexual assault and sexual abuse;
8 and
9 (vii) report writing techniques in accordance
10 with the curriculum standards in this paragraph
11 (6).
12 (B) This training must also be presented in all
13 full and part-time basic law enforcement academies.
14 (C) Instructors providing this training shall have
15 successfully completed training on evidence-based,
16 trauma-informed, victim-centered responses to cases of
17 sexual assault and sexual abuse and have experience
18 responding to sexual assault and sexual abuse cases.
19 (D) The Illinois State Police shall adopt rules,
20 in consultation with the Office of the Attorney
21 General and the Illinois Law Enforcement Training
22 Standards Board, to determine the specific training
23 requirements for these courses, including, but not
24 limited to, the following:
25 (i) evidence-based curriculum standards for
26 report writing and immediate response to sexual

1 assault and sexual abuse, including
2 trauma-informed, victim-centered interview
3 techniques, which have been demonstrated to
4 minimize retraumatization, for all State police
5 officers; and
6 (ii) evidence-based curriculum standards for
7 trauma-informed, victim-centered investigation
8 and interviewing techniques, which have been
9 demonstrated to minimize retraumatization, for
10 cases of sexual assault and sexual abuse for all
11 State police officers who conduct sexual assault
12 and sexual abuse investigations.
13 (7) Training; human trafficking. The Division of the
14 Academy and Training shall conduct or approve a training
15 program in the detection and investigation of all forms of
16 human trafficking, including, but not limited to,
17 involuntary servitude under subsection (b) of Section 10-9
18 of the Criminal Code of 2012, involuntary sexual servitude
19 of a minor under subsection (c) of Section 10-9 of the
20 Criminal Code of 2012, and trafficking in persons under
21 subsection (d) of Section 10-9 of the Criminal Code of
22 2012. This program shall be made available to all cadets
23 and State police officers.
24 (8) Training; hate crimes. The Division of the Academy
25 and Training shall provide training for State police
26 officers in identifying, responding to, and reporting all

1 hate crimes.
2 (9) Training; cell phone medical information. The
3 Division of the Academy and Training shall develop and
4 require each State police officer to complete training on
5 accessing and utilizing medical information stored in cell
6 phones. The Division may use the program approved under
7 Section 2310-711 of the Department of Public Health Powers
8 and Duties Law of the Civil Administrative Code of
9 Illinois to develop the Division's program.
10 (d) The Division of the Academy and Training shall
11administer and conduct a program consistent with 18 U.S.C.
12926B and 926C for qualified active and retired Illinois State
13Police officers.

16 Section 15. The Illinois Police Training Act is amended by
17adding Section 10.25 as follows:

19 Sec. 10.25. Training; cell phone medical information. The
20Board shall develop and require each law enforcement officer
21to participate in training on accessing and utilizing medical
22information stored in cell phones. The Board may use the
23program approved under Section 2310-711 of the Department of
24Public Health Powers and Duties Law of the Civil

2program.
