HOUSE BILL NO. 5163

October 17, 2023, Introduced by Reps. McKinney, Rheingans, Byrnes, Brixie, Scott, Hope, Wegela and Wilson and referred to the Committee on Regulatory Reform.

A bill to amend 1893 PA 206, entitled

"The general property tax act,"

by amending section 2a (MCL 211.2a), as amended by 1982 PA 539.

the people of the state of michigan enact:

Sec. 2a. (1) For purposes of section 2, a mobile home which that is not covered by section 41 of Act No. 243 of the Public Acts of 1959, being section 125.1041 of the Michigan Compiled Laws, and subject to the specific tax described in section 41 of 1959 PA 243, MCL 125.1041, while located on land otherwise assessable as real property under this act, and whether or not permanently affixed to the soil, shall must be considered real property and shall must be assessed as part of the real property upon on which the mobile home is located.

(2) As used in this section: , "mobile

(a) "Camping trailer" means a vehicular portable temporary living quarters that is used for recreational camping or travel and is of a size and weight as not to require special highway movement permits when drawn by a motor vehicle.

(b) "Mobile home" does not include a either of the following:

(i) A travel trailer or camping trailer which is either that meets 1 of the following:

(A) Is parked in a campground licensed by this state for not more than 180 days in any calendar year. , or

(B) Is parked upon on private property, including a designated storage area of a licensed campground, for the sole purpose of storage.

(ii) (3) As used in this section, "mobile home" does not include a A truck camper which that is parked in a campground licensed by this state, which is a portable structure , designed and constructed to be loaded onto, or affixed to, the bed or chassis of a truck, and which is used to provide temporary living quarters for recreational camping or travel.

(4) For purposes of this section, the following definitions shall apply:

(c) (a) A travel trailer is "Travel trailer" means a vehicular portable structure that is mounted on wheels, and is of a size and weight as not to require special highway movement permits when drawn by a stock passenger automobile or when drawn with a fifth wheel hitch mounted on a motor vehicle, and is primarily designed, constructed, and used to provide temporary living quarters for recreational camping or travel.

(b) A camping trailer is a vehicular portable temporary living quarters used for recreational camping or travel and of a size and weight as not to require special highway movement permits when drawn by a motor vehicle.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5162 (request no. 02944'23) of the 102nd Legislature is enacted into law.
