1.1A bill for an act
1.2proposing an amendment to the Minnesota Constitution, amending article XI,
1.3section 4, prohibiting the state use of appropriation bonds.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.6An amendment to the Minnesota Constitution is proposed to the people. If the
1.7amendment is adopted, article XI, section 4, will read:
1.8Sec. 4. (a) The state may contract public debts for which its full faith, credit and taxing
1.9powers may be pledged at the times and in the manner authorized by law, but only for
1.10the purposes and subject to the conditions stated in section 5. Public debt includes any
1.11obligation payable directly in whole or in part from a tax of state wide application on any
1.12class of property, income, transaction or privilege, but does not include any obligation
1.13which is payable from revenues other than taxes.
1.14(b) Upon the adoption of this paragraph, the state shall not contract public debt
1.15payable directly in whole or in part from a tax of state wide application on any class of
1.16property, income, transaction, or privilege without a pledge by the state of its full faith,
1.17credit, and taxing powers.

1.18    Sec. 2. SUBMISSION TO VOTERS.
1.19The proposed amendment must be submitted to the people at the 2012 general
1.20election. The question submitted must be:
2.1"Shall the Minnesota Constitution be amended to prohibit the state use of public
2.2debt that is not backed by the full faith and credit of the state?
