1.1A senate resolution
1.2urging the Governor to exclude public schools from any further executive
1.3orders issued subject to the emergency powers in Minnesota Statutes, chapter
1.412.
1.5WHEREAS, the Governor has specific emergency powers granted under Minnesota Statutes,
1.6section 12.21, subdivision 3; and
1.7WHEREAS, the Governor may authorize the commissioner of education to alter schedules,
1.8curtail school activities, or order schools closed under Minnesota Statutes, section 12.21, subdivision
1.93, clause (11); and
1.10WHEREAS, the Governor issued Executive Orders 20-2, 20-19, 20-41, and 20-57, regarding
1.11the operation of public schools; and
1.12WHEREAS, under the Minnesota Constitution, Article XIII, section 1, it is the responsibility
1.13of the legislature to secure a thorough and efficient system of public schools throughout the state;
1.14and
1.15WHEREAS, our public schools provide an essential service to their surrounding communities;
1.16and
1.17WHEREAS, local officials are better suited to respond to the distinct needs of their
1.18communities; and
1.19WHEREAS, responding to an emergency is not the same in every public school or school
1.20district statewide; and
1.21WHEREAS, public school leaders should be able to determine the need for school closures
1.22in their community; and
1.23NOW, THEREFORE, BE IT RESOLVED by the legislature of the State of Minnesota
1.24that the Governor should not exercise the emergency powers in Minnesota Statutes, section 12.21,
1.25subdivision 3, clause (11), to alter school schedules, curtail school activities, or order schools closed
1.26and prevent the reopening of schools for the 2020-2021 school year and the typical presence of
1.27students in school buildings.
1.28BE IT FURTHER RESOLVED that the Secretary of the Senate is directed to prepare an
1.29enrolled copy of this resolution, to be authenticated by his signature and those of the Speaker of
1.30the House of Representatives, the Chair of the Senate Rules and Administration Committee, and
1.31the Chief Clerk of the House of Representatives and transmit it to the Governor of the State of
1.32Minnesota.
