Senate Bill 3042

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF MARSHALL COUNTY, MISSISSIPPI, TO EMPLOY ADDITIONAL, PART-TIME ASSISTANT COUNTY PROSECUTING ATTORNEYS AS DETERMINED NECESSARY, TO DESIGNATE THE RESPONSIBILITIES OF SUCH ATTORNEYS, AND TO PAY SUCH ATTORNEYS AN ANNUAL SALARY OR APPEARANCE FEE NOT TO EXCEED 90% OF THE AMOUNT PAID TO THE ELECTED PROSECUTING ATTORNEY OF THE COUNTY; TO REQUIRE THAT THE SALARY AUTHORIZED BY THE BOARD FOR ADDITIONAL, PART-TIME ASSISTANT COUNTY PROSECUTING ATTORNEYS BE THE SOLE AND COMPLETE SALARY PAID BY THE COUNTY FOR SUCH ATTORNEYS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  As used in this act, the following terms shall have the following meanings unless a different meaning is clearly indicated by the context in which they are used:

          (a)  "County" means Marshall County, Mississippi.

          (b)  "Board" means the Board of Supervisors of Marshall County, Mississippi.

     SECTION 2.  The board is authorized and empowered, in its discretion, to employ such additional, part-time assistant county prosecuting attorneys as it determines necessary, to designate the duties and responsibilities of such attorneys, and to pay such attorneys an annual salary or appearance fee in an amount that shall not exceed ninety percent (90%) of the amount paid to the elected prosecuting attorney of the county.  The salary authorized by the board for additional, part-time assistant county prosecuting attorneys shall be the sole and complete salary to be paid by the county for such attorneys, notwithstanding any other provision of law to the contrary.

     SECTION 3.  This act shall take effect and be in force from and after its passage.
