SYNOPSIS
Urges Congress and President to enact "Do Not Disturb Act."
CURRENT VERSION OF TEXT

A Joint Resolution respectfully urging Congress and the President of the United States to enact the "Do Not Disturb Act."
Whereas, American citizens receive an estimated 2.1 billion spam and scam calls per month, resulting in over 195 million hours of wasted time answering these calls in 2023; and
Whereas, These spam and scam calls are dangerous and abusive fraud tactics that affect every American citizen with a phone; and
Whereas, The United States Supreme Court's decision in Facebook, Inc. v. Duguid, 141 S. Ct. 1163 (2021) held that the definition of "automatic telephone dialing system" as defined in the Telephone consumer Protection Act of 1991 (TCPA) only includes devices that have the capacity to either store a telephone number using a random or sequential generator or to produce a telephone number using a random or sequential generator, which definition excludes a bulk of robocalls taking place today; and
Whereas, As a result, spam and scam callers continue to exploit technological loopholes and harass and take advantage of American citizens, especially seniors citizens; and
Whereas, To protect consumers from the bombardment of dangerous and unwanted calls and texts, Congressman Frank Pallone, Jr. introduced a package of bills known collectively as the "Do Not Disturb Act"; and
Whereas, Specifically, the bill package, in part, expands anti-robocall protections, combats the use of artificial intelligence for scams, and alleviates the cost of robocall blocking technology for consumers; and
Whereas, Congress is respectfully urged to pass the "Do Not Disturb Act" and to continue to research and restrict unsolicited phone calls from scammers; now, therefore,
Be It Resolved by the Senate and General Assembly of the State of New Jersey:
1. The State of New Jersey respectfully urges Congress and the President of the United States to enact the "Do Not Disturb Act."
2. Copies of this resolution, as filed with the Secretary of State, shall be transmitted by the Clerk of the General Assembly or the Secretary of the Senate to the President of the United States, the Speaker and the Minority Leader of the United States House of Representatives, the Majority and Minority Leaders of the United States Senate, and each member of Congress elected from this State.
3. This joint resolution shall take effect immediately.
STATEMENT
This joint resolution urges Congress to pass, and for the President to sign, the "Do Not Disturb Act."
