       AN  ACT  to  amend the vehicle and traffic law, in relation to directing
         the commissioner of motor vehicles  to  provide  certain  services  on
         Fishers Island for a limited period of time
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 206 of the vehicle and traffic  law,  as  added  by
    2  chapter 141 of the laws of 1969, is amended to read as follows:
    3    S 206. Deputization  of agents. 1. The commissioner may, in his OR HER
    4  discretion, deputize any person to act for the commissioner, subject  to
    5  rules and limitations prescribed by him OR HER, for the purpose of issu-
    6  ing  or  renewing  licenses,  registrations  and number plates. Any such
    7  license, registration or number plate so  issued  or  renewed  shall  be
    8  subject  to cancellation by the commissioner, if improperly issued. Such
    9  deputies shall not  receive  compensation  from  the  state  under  this
   10  section,  and  no fee in addition to the fees prescribed by law shall be
   11  charged any applicant unless such fee has been approved by  the  commis-
   12  sioner.  The commissioner may, without a hearing, revoke at any time the
   13  authority granted to any person under this [section] SUBDIVISION.
   14    2. THE COMMISSIONER SHALL DEPUTIZE A PERSON TO ACT FOR THE COMMISSION-
   15  ER, SUBJECT TO RULES AND LIMITATIONS PRESCRIBED BY HIM OR HER,  FOR  THE
   16  PURPOSE OF ISSUING OR RENEWING LICENSES, REGISTRATIONS AND NUMBER PLATES
   17  FOR  PERSONS LIVING ON FISHERS ISLAND IN THE TOWN OF SOUTHOLD, COUNTY OF
   18  SUFFOLK. IN CARRYING OUT THE PROVISIONS OF THIS SUBDIVISION, SUCH DEPUTY
   19  SHALL ISSUE AND RENEW SUCH LICENSES,  INCLUDING  THE  ADMINISTRATION  OF
   20  WRITTEN  AND ROAD TESTS, EYE EXAMINATIONS AND PHOTOGRAPHS, REGISTRATIONS
   21  AND NUMBER PLATES FROM A FACILITY LOCATED ON FISHERS ISLAND. SUCH FACIL-
   22  ITY SHALL BE AVAILABLE FOR SERVICE TWICE ANNUALLY, AND SHALL BE OPERATED
   23  EACH TIME FOR A PERIOD OF TIME TO BE DETERMINED BY THE COMMISSIONER, BUT

    1  FOR NOT LESS THAN TWO BUSINESS DAYS. ANY SUCH LICENSE,  REGISTRATION  OR
    2  NUMBER  PLATE  SO  ISSUED OR RENEWED SHALL BE SUBJECT TO CANCELLATION BY
    3  THE COMMISSIONER, IF IMPROPERLY ISSUED. SUCH DEPUTY  SHALL  NOT  RECEIVE
    4  COMPENSATION  FROM  THE STATE UNDER THIS SECTION, AND NO FEE IN ADDITION
    5  TO THE FEES PRESCRIBED BY LAW SHALL BE CHARGED ANY APPLICANT UNLESS SUCH
    6  FEE HAS BEEN APPROVED BY THE COMMISSIONER. THE COMMISSIONER MAY, WITHOUT
    7  A HEARING, REVOKE AT ANY TIME THE AUTHORITY GRANTED TO SUCH PERSON UNDER
    8  THIS SUBDIVISION.  IN LIEU OF A DEPUTY,  THE  COMMISSIONER  MAY  UTILIZE
    9  EMPLOYEES OF THE DEPARTMENT.
   10    S  2.  This  act shall take effect on the ninetieth day after it shall
   11  have become a law.
