A BILL TO BE ENTITLED
 
AN ACT
  relating to defense of certain actions brought against election
  judges and clerks.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 32, Election Code, is amended by adding
  Subchapter Z to read as follows:
  SUBCHAPTER Z.  MISCELLANEOUS PROVISIONS
         Sec. 32.901.  DEFENSE OF SUIT AGAINST ELECTION JUDGES AND
  CLERKS. A district attorney shall defend an action, including an
  action for writ of mandamus, brought against an election judge or
  election clerk that alleges that the judge or clerk violated a
  provision of this code while acting in the judge's or clerk's
  official capacity in the county served by the district attorney.
         SECTION 2.  The change in law made by this Act applies only
  to an action filed on or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
