Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-223.3 as follows:
§8.01-223.3. Social media platforms; certain requests; identifying information; ownership.
A. As used in this section:
"Social media platform" means a website or Internet medium that (i) permits a person to become a registered user, establish an account, or create a profile for the purpose of allowing users to create, share, and view user-generated content through such an account or profile; (ii) enables one or more users to generate content that can be viewed by other users of the medium; and (iii) primarily serves as a medium for users to interact with content generated by other users of the medium.
B. In any civil cause of action involving the publishing of content giving rise to such cause of action on a social media platform, the owner or operator of such platform shall comply with any requests from a party to the action concerning (i) any identifying information regarding any person alleged to have published such content on such platform and (ii) restoration of access to any person claiming ownership of an account created on such platform, provided such person can prove original ownership of such account.
C. The provisions of this section shall not be construed to narrow the provisions of §8.01-49.1.
