A BILL to amend and reenact §19.2-190.1 of the Code of Virginia, relating to certification of ancillary traffic infractions and civil offenses.

Be it enacted by the General Assembly of Virginia:

1. That §19.2-190.1 of the Code of Virginia is amended and reenacted as follows:

§19.2-190.1. Certification of ancillary offenses.

Upon certification of any felony offense pursuant to this chapter, the court shall also certify any ancillary traffic infraction or misdemeanor or civil offense to the clerk of the circuit court provided that the attorney for the Commonwealth and the accused consent to such certification. Any traffic infraction or misdemeanor or civil offense certified pursuant to this section shall proceed in the same manner as a misdemeanor appealed to circuit court pursuant to §16.1-136.
