AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee for Courts of Justice

A BILL to direct the Secretary of Health and Human Resources to convene a work group to study transfer of custody for patients under an emergency custody order or temporary detention order.

Be it enacted by the General Assembly of Virginia:

1. §1. That the Secretary of Health and Human Resources (the Secretary) shall convene a work group to develop recommendations concerning transfer of custody for patients under an emergency custody order or temporary detention order. The work group shall consider changes and improvements to the process for individuals who are under an emergency custody order or a temporary detention order to relieve pressure from law enforcement and health care professionals and evaluate the role of alternative transportation agencies, and any other relevant issues related to the custody of patients under an emergency custody order or temporary detention order. The work group shall include representatives from the Medical Society of Virginia, the College of Emergency Physicians, the Virginia Hospital and Healthcare Association, the Virginia Sheriffs' Association, the Virginia Association of Health Plans, the Virginia Association of Police Chiefs, the Office of the Executive Secretary of the Supreme Court, the Virginia Association of Community Services Boards, the Department of Behavioral Health and Developmental Services, the Department of Medical Assistance Services, and any other relevant stakeholders at the discretion of the Secretary. The work group shall submit a report on its findings and recommendations prior to November 1, 2024, to the Secretary and the Chairmen of the House Committee on Health and Human Services, the Senate Committee on Education and Health, and the Senate Committee on Rehabilitation and Social Services.
