An Act

 

amending title 32, chapter 32, article 1, Arizona Revised Statutes, by adding section 32-3230.02; amending title 36, chapter 1, article 1, Arizona Revised Statutes, by adding section 36-116; appropriating monies; relating to patient information.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 32, chapter 32, article 1, Arizona Revised Statutes, is amended by adding section 32-3230.02, to read:

START_STATUTE32-3230.02. Gun safety; patient information

A physician who is licensed pursuant to chapter 13, 14 or 17 of this title, a physician assistant who is licensed pursuant to chapter 25 of this title or a nurse practitioner who is licensed pursuant to chapter 15 of this title and who provides well-baby and pediatric services shall inform the parent or guardian of a child during an office visit for such services of gun safety measures that may be implemented in the home, including proper gun storage, and the risks to children who find a gun in the home.  A physician, physician assistant or nurse practitioner meets the notification requirements of this section by providing the information verbally or in writing or by providing the parent or guardian with a pamphlet prepared by the department of health services pursuant to section 36-116. Sec. 2. Title 36, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 36-116, to read:

START_STATUTE36-116. Gun safety; pamphlet; distribution; posting

A. On or before January 2, 2025, the department shall prepare a pamphlet that includes information regarding gun safety measures that parents and guardians may implement in the home where children are present, including proper gun storage, and the risks to children who find a gun in the home. The department shall update this pamphlet as necessary.

B. The department shall distribute the pamphlet prepared pursuant to subsection A of this section free of charge to physicians, physician assistants, nurse practitioners and health care institutions on request and shall post the pamphlet on the department's website.

C. The department may accept and spend gifts, grants and donations for the purposes of this section. END_STATUTE

Sec. 3. Appropriation; department of health services; gun safety pamphlet; exemption

A. The sum of $250,000 is appropriated from the state general fund in fiscal year 2024-2025 to the department of health services to prepare the pamphlet that includes information regarding gun safety measures as required by section 36-116, Arizona Revised Statutes, as added by this act.

B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to the lapsing of appropriations.
