AN ACT
Amending title
36, chapter 6, article 1, Arizona Revised Statutes, by adding section 36‑607;
relating to public health control.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 36, chapter 6, article 1, Arizona Revised Statutes, is amended by adding section 36-607, to read:
36-607. Third-party delivery
companies; drivers; food handler requirements; definitions
A. A third‑party delivery
company may not allow a person to act as a third‑party delivery company
driver unless the driver possesses one of the following documents showing the
completion of a food handler training course:
1. A valid food employee or handler
certificate or identification card that is issued by a county in this state.
2. A valid food handler certificate
of successful completion of a food handler training course that meets the
requirements of section 11‑269.12 and that has been issued for not more
than three years.
B. For the purposes of this section:
1. "Digital network or software
application" means any online‑enabled application, software, website
or system that is offered or used by a third‑party delivery company and
that enables a potential customer to arrange a delivery by a third‑party
delivery company driver.
2. "Third‑party delivery
company":
(a) Means an
entity that operates in this state, that uses a digital network or software
application to connect a customer to food and beverage delivery services
provided by third‑party delivery company drivers and that may own,
operate or control a personal motor vehicle of a third‑party delivery
company driver.
(b) Does not
include:
(i) This state
or a county, city, town or political subdivision of this state and any related
entity, a nonprofit agency or any other public body that coordinates, operates,
promotes or sponsors food and beverage delivery services.
(ii) Any entity
that delivers food or beverage from a permitted food establishment owned by the
entity and that directly employs all of the delivery drivers.
3. "Third‑party delivery
company driver" means an individual who receives connections to potential
customers or a permitted food establishment from a third‑party delivery
company in exchange for payment of a fee to the third‑party delivery
company and who operates a motor vehicle that is used to provide third‑party
delivery company services.
