AN ACT

 

allowing school districts to correct overstatements of daily route mileage.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  School district overstatements of daily route mileage; correction; interest; resolution

A.  Notwithstanding sections 15-905 and 15-915, Arizona Revised Statutes, a school district that overstated its daily route mileage during fiscal years 2011‑2012, 2012‑2013 and 2013-2014 shall correct the overstatement over a three‑year period beginning in fiscal year 2016-2017 and ending in fiscal year 2018‑2019.  The repayment amount shall be paid in equal installments in each of the three fiscal years.  This subsection applies to a school district if all of the following conditions exist:

1.  The school district is a common school district.

2.  The school district's average daily membership for fiscal year 2014‑2015 was more than one hundred pupils but less than one hundred fifty pupils.

3.  The total amount of the overstatement is more than two hundred thousand dollars but less than two hundred fifty thousand dollars.

B.  In addition to monies required to be repaid pursuant to subsection A of this section, accrued interest must be paid at a rate determined by the superintendent of public instruction.

C.  The governing board of a school district to which this section applies shall adopt a formal resolution to comply with this section and, if requested by the department of education, submit to annual daily route mileage audits.

Sec. 2.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
