AN ACT

 

amending title 41, chapter 39, Arizona Revised Statutes, by adding article 3; relating to crime statistics reporting.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 39, Arizona Revised Statutes, is amended by adding article 3, to read:

ARTICLE 3.  CRIME STATISTICS REPORTING

START_STATUTE41-4181.  Crime statistics; report on websites

A.  All law enforcement agencies of this state, universities, community college districts, cities, towns and counties shall post on the agencies' websites statistics on the number of crimes that are reported within their jurisdictions, by category, and that are required to be reported to the federal bureau of investigation.  The agencies shall maintain these statistics on their websites for at least five consecutive years.

B.  In addition to the requirements of subsection A, each law enforcement agency shall report, by category, the number of crimes that have been cleared during that year, the number of cases referred for prosecution and the number of cases cleared by arrest.

C.  The law enforcement agency shall post the statistics required pursuant to this section on a calendar year basis by July 1 of the following year.

D.  If the law enforcement agency does not maintain a website, the agency shall report the statistics required by this section on the website of the appropriate governmental entity that has jurisdiction over the agency. END_STATUTE

START_STATUTE41-4182.  County attorney; report on prosecutions referred; definition

A.  Each county attorney shall report annually on the agency website the number of cases, by category, that were referred to the county attorney for prosecution by each law enforcement agency in that county.

B.  The county attorney shall post the information required pursuant to this section on a calendar year basis by July 1 of the following year.

C.  For the purposes of this section, "agency website" means agency web site as defined in section 41‑4151. END_STATUTE
