HOUSE BILL NO. 312

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOME COMMUNITIES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend Title 25, section 7006(a)(13)a. of the Delaware Code by striking the existing language and substituting the following in place thereof:

"a. Maintain and regrade the lot area where necessary and in good faith to prevent the accumulation of standing water and/or stagnant water thereon and to prevent the detrimental effects of moving water; "standing water" shall be understood to mean motionless water, not flowing in a stream, tide or current, that has not dissipated within 24 hours; "stagnant water" shall be understood to mean motionless water, not flowing in a stream, tide or current, that has become foul or stale from standing, but shall not include wetlands.".

SYNOPSIS

This bill amends Title 25, section 7006 to clarify the terms "standing water" and "stagnant water".
