       Senator Bracy moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1354 and 1355
    4  insert:
    5         c. For an offense listed under this subparagraph, a court
    6  may depart from the applicable mandatory minimum sentence under
    7  sub-subparagraph b. if the court finds in giving due regard to
    8  the nature of the defendant’s crime, the defendant’s criminal
    9  history and character, and the defendant’s chance of successful
   10  rehabilitation, there are compelling reasons on the record that
   11  imposition of the mandatory minimum is not necessary for the
   12  protection of the public.
