A bill to be entitled
2An act relating to cost-benefit, return-on-investment, and
3dynamic scoring techniques; creating s. 216.138, F.S.;
4authorizing the President of the Senate or the Speaker of
5the House of Representatives to request special impact
6sessions of consensus estimating conferences to evaluate
7proposed legislation based on specified techniques;
8providing for the information used in the evaluations to
9be available to the public unless otherwise exempt from
10disclosure; requiring the Office of Economic and
11Demographic Research to develop protocols and procedures
12to be used by the consensus estimating conferences when
13evaluating proposed legislation; establishing minimum
14requirements; requiring a report to the Legislature;
15requiring the use of the protocols and procedures
16following legislative approval until such approval is
17affirmatively revoked; amending s. 216.133, F.S.;
18conforming a cross-reference to changes made by the act;
19providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:

23 Section 1. Section 216.138, Florida Statutes, is created
24to read:
25 216.138 Authority to request additional analysis of
26legislation.-The President of the Senate or the Speaker of the
27House of Representatives may request special impact sessions of
28consensus estimating conferences to evaluate proposed
29legislation based on tools and models not generally employed by
30the conferences, including cost-benefit, return-on-investment,
31or dynamic scoring techniques, when suitable and appropriate for
32the legislation being evaluated. Unless exempt from s.
33119.07(1), information used to develop the analyses shall be
34available to the public.
35 Section 2. The Office of Economic and Demographic
36Research, acting in consultation with the principals of the
37consensus estimating conferences and after receiving public
38input, shall develop protocols and procedures necessary to
39implement s. 216.138, Florida Statutes. At a minimum, the
40protocols and procedures to be used for evaluating specific
41proposed legislation shall include cost-benefit, return-on-
42investment, and dynamic scoring techniques and may include
43additional, appropriate economic techniques. Additionally, the
44protocols and procedures must address the format for reporting
45results and provide proposed linkages to the appropriations and
46revenue forecasting processes, including any statutory changes
47that may be needed. The linkages must be consistent with the
48constitutional requirement for a balanced budget. The office
49shall submit a report of its findings and recommendations to the
50President of the Senate and the Speaker of the House of
51Representatives by December 1, 2010. Subject to approval by the
52President of the Senate and the Speaker of the House of
53Representatives following the submission of the report, the
54protocols and procedures shall be used to the extent feasible
55for the analysis of specific proposed legislation by consensus
56estimating conferences as provided in s. 216.138, Florida
57Statutes, unless and until such approval is subsequently
58affirmatively revoked.
59 Section 3. Section 216.133, Florida Statutes, is amended
60to read:

62As used in ss. 216.133-216.138 216.133-216.137:
63 (1) "Consensus estimating conference" includes the
64Economic Estimating Conference, the Demographic Estimating
65Conference, the Revenue Estimating Conference, the Education
66Estimating Conference, the Criminal Justice Estimating
67Conference, the Occupational Forecasting Conference, the Early
68Learning Programs Estimating Conference, the Self-Insurance
69Estimating Conference, the Florida Retirement System Actuarial
70Assumption Conference, and the Social Services Estimating
71Conference.
72 (2) "Official information" means the data, forecasts,
73estimates, analyses, studies, and other information which the
74principals of a consensus estimating conference unanimously
75adopt for purposes of the state planning and budgeting system.
76 (3) "Consensus" means the unanimous consent of all of the
77principals of a consensus estimating conference.
78 Section 4. This act shall take effect upon becoming a law.
