3Prevention Authority Trust Fund; creating s. 860.1571,
4F.S.; creating the Motor Vehicle and Cargo Theft
5Prevention Authority Trust Fund within the Executive
6Office of the Governor; providing for source of moneys and
7purposes; providing that moneys from the trust fund shall
8be used to supplement, not supplant, other moneys
9available; providing for future review and termination or
10re-creation of the trust fund; providing a contingent
11effective date.

13Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 860.1571, Florida Statutes, is created
16to read:
17 860.1571 Motor Vehicle and Cargo Theft Prevention
18Authority Trust Fund.-
19 (1) The Motor Vehicle and Cargo Theft Prevention Authority
20Trust Fund is created within the Executive Office of the
21Governor and shall consist of any public or private moneys
22received by the authority. The authority shall administer the
23trust fund. Subject to legislative appropriation, moneys in the
24trust fund shall only be used to pay the expenses of the
25authority and to carry out the purposes of s. 860.157.
26 (2) The authority shall allocate moneys in the trust fund
27to qualified public and private entities for the purpose of
28establishing, maintaining, and supporting programs that are
29designed to prevent motor vehicle and cargo theft, including
30programs that increase the effectiveness of law enforcement
31investigation efforts and successful prosecution and programs
32that educate and assist the public in the prevention of motor
33vehicle and cargo theft.
34 (3) Moneys from the trust fund shall be used to
35supplement, not supplant, other moneys available for motor
36vehicle and cargo theft prevention.
37 (4) In accordance with s. 19(f)(2), Art. III of the State
38Constitution, the trust fund shall, unless terminated sooner, be
39terminated on July 1, 2014. Before its scheduled termination,
40the trust fund shall be reviewed as provided in s. 215.3206(1)
41and (2).
42 Section 2. This act shall take effect July 1, 2010, if
43House Bill 425 or substantially similar legislation is adopted
44in the same legislative session or an extension thereof and
45becomes law.
