13 | Be It Enacted by the Legislature of the State of Florida: |
14 |

15 | Section 1. Section 860.1571, Florida Statutes, is created |
16 | to read: |
17 | 860.1571 Motor Vehicle and Cargo Theft Prevention |
18 | Authority Trust Fund.- |
19 | (1) The Motor Vehicle and Cargo Theft Prevention Authority |
20 | Trust Fund is created within the Executive Office of the |
21 | Governor and shall consist of any public or private moneys |
22 | received by the authority. The authority shall administer the |
23 | trust fund. Subject to legislative appropriation, moneys in the |
24 | trust fund shall only be used to pay the expenses of the |
25 | authority and to carry out the purposes of s. 860.157. |
26 | (2) The authority shall allocate moneys in the trust fund |
27 | to qualified public and private entities for the purpose of |
28 | establishing, maintaining, and supporting programs that are |
29 | designed to prevent motor vehicle and cargo theft, including |
30 | programs that increase the effectiveness of law enforcement |
31 | investigation efforts and successful prosecution and programs |
32 | that educate and assist the public in the prevention of motor |
33 | vehicle and cargo theft. |
34 | (3) Moneys from the trust fund shall be used to |
35 | supplement, not supplant, other moneys available for motor |
36 | vehicle and cargo theft prevention. |
37 | (4) In accordance with s. 19(f)(2), Art. III of the State |
38 | Constitution, the trust fund shall, unless terminated sooner, be |
39 | terminated on July 1, 2014. Before its scheduled termination, |
40 | the trust fund shall be reviewed as provided in s. 215.3206(1) |
41 | and (2). |
42 | Section 2. This act shall take effect July 1, 2010, if |
43 | House Bill 425 or substantially similar legislation is adopted |
44 | in the same legislative session or an extension thereof and |
45 | becomes law. |
