A bill to be entitled
2An act relating to procurement of commodities and
3contractual services; creating s. 287.05705, F.S.;
4providing that an agency, county, or municipality that is
5required to make purchases of commodities or contractual
6services through competitive solicitation must provide
7vendors the option to submit competitive sealed bids
8through a uniform secure electronic interactive Internet
9system; requiring specified notification in invitations to
10bid; requiring the Department of Management Services to
11adopt rules establishing procedures and requirements for
12the electronic submission, receipt, and processing of
13competitive sealed bids; providing exemptions; providing
14an effective date.

16Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 287.05705, Florida Statutes, is created
19to read:
20 287.05705 Online submission of competitive sealed bids.-
21 (1) Except as provided in subsections (4) and (5), an
22agency, county, or municipality that is required to make
23purchases of commodities or contractual services through
24competitive solicitation must provide vendors the option to
25submit competitive sealed bids through a uniform secure
26electronic interactive Internet system.
27 (2) Agencies, counties, and municipalities must include in
28invitations to bid notification to vendors apprising them of the
29option to submit sealed bids electronically and of any special
30conditions, requirements, or procedures particular to electronic
31submissions of competitive sealed bids.
32 (3) The department shall adopt rules establishing
33procedures and requirements for the electronic submission,
34receipt, and processing of competitive sealed bids under this
35section.
36 (4) A county or municipality that is without available
37high-speed Internet access is exempt from the requirements of
38subsections (1) and (2) until such time as high-speed Internet
39access becomes available to the county or municipality.
40 (5) A county or municipality with a population of less
41than 25,000 is exempt from the requirements of subsections (1)
42and (2).
43 Section 2. This act shall take effect July 1, 2010.
