A bill to be entitled
2An act relating to license plates; amending ss. 320.08056
3and 320.08058, F.S.; revising authorized uses of revenue
4received from the sale of the Sea Turtle license plate;
5creating a Go Green license plate, a Preserving the Past
6license plate, and a Peace license plate; establishing
7annual use fees for the plate; providing for the
8distribution of use fees received from the sale of the
9plate; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Paragraphs (rrr), (sss), and (ttt) are added to
14subsection (4) of section 320.08056, Florida Statutes, to read:
15 320.08056 Specialty license plates.-
16 (4) The following license plate annual use fees shall be
17collected for the appropriate specialty license plates:
18 (rrr) Go Green license plate, $25.
19 (sss) Preserving the Past license plate, $25.
20 (ttt) Peace license plate, $25.
21 Section 2. Subsection (18) of section 320.08058, Florida
22Statutes, is amended, and subsections (70), (71), and (72) are
23added to that section, to read:
24 320.08058 Specialty license plates.-
25 (18) SEA TURTLE LICENSE PLATES.-
26 (a) The department shall develop a Sea Turtle license
27plate as provided in this section. The word "Florida" must
28appear at the top of the plate, the words "Helping Sea Turtles
29Survive" must appear at the bottom of the plate, and the image
30of a sea turtle must appear in the center of the plate.
31 (b) The first $500,000 of annual use fees shall be
32deposited in the Marine Resources Conservation Trust Fund in the
33Fish and Wildlife Conservation Commission and shall be used by
34the Florida Marine Turtle Protection Program to conduct sea
35turtle protection, research, and recovery programs. The next
36$215,000 in annual use fees shall be distributed to the
37Caribbean Conservation Corporation to fund sea turtle research
38and education programs. The Caribbean Conservation Corporation
39shall annually distribute assigned funds through a Sea Turtle
40Grants Program that supports sea turtle research and education
41activities of Florida-based nonprofit groups, education and
42research institutions, and coastal counties in this state. The
43Caribbean Conservation Corporation shall write and publish
44procedures for submitting grant applications and criteria for
45allocating available funds, and shall appoint a technical
46advisory committee, composed of at least five members, including
47two representatives from the Fish and Wildlife Conservation
48Commission, to establish funding priorities and select grant
49recipients from proposals submitted by eligible entities. Two of
50the members shall be selected from the Fish and Wildlife
51Conservation Commission; one member shall be selected on a
52rotating biennial basis from a county bordering on the Atlantic
53Coast with sea turtle nesting sites; one member shall be
54selected on a rotating biennial basis from a county bordering on
55the Gulf Coast with sea turtle nesting sites; one member shall
56be the executive director of the Caribbean Conservation
57Corporation; and two members shall be selected at large. Any
58additional annual revenue shall be distributed as follows: 70
59percent shall be deposited in the Marine Resources Conservation
60Trust Fund and used by the Florida Marine Turtle Protection
61Program for sea turtle conservation activities and 30 percent
62shall be assigned to the Caribbean Conservation Corporation for
63distribution through the Sea Turtle Grants Program. From the
64funds distributed to the Caribbean Conservation Corporation, an
65amount not to exceed 10 percent of the total annual revenue from
66the sale of the plate may be used for marketing the Sea Turtle
67license plate and for administrative costs directly associated
68with the grants program. A maximum of 15 percent of the funds
69distributed to the Caribbean Conservation Corporation may be
70expended for administrative costs directly associated with the
71grants program, and a maximum of 10 percent may be used to
72promote and market the Sea Turtle license plate. Funds received
73by the Caribbean Conservation Corporation from the Sea Turtle
74license plate or the Sea Turtle Grants Program and funds
75received by any grant recipient of the Sea Turtle Grants Program
76may not be used for litigation.
77 (70) GO GREEN LICENSE PLATES.-
78 (a) The department shall develop a Go Green license plate
79as provided in this section. Go Green license plates must bear
80the colors and design approved by the department. The word
81"Florida" must appear at the top of the plate, and the words "Go
82Green" must appear at the bottom of the plate.
83 (b) The annual use fees shall be distributed to the
84Coalition for Renewable Energy Solutions, Inc., which shall
85administer the fees as follows:
86 1. The coalition may retain all revenue from the annual
87use fees until all startup costs for developing and establishing
88the plate have been recovered. Thereafter, up to 10 percent of
89the annual use fees may be used for administrative costs
90directly associated with the operation of the coalition and
91promotion and marketing of the plate.
92 2. Any remaining funds shall be used by the coalition to
93fund programs and projects that publicize renewable energy
94solutions and encourage a cleaner and safer environmental
95future, as follows:
96 a. Up to 40 percent to fund the "Go Green Florida" Grants
97and Awards Program, including monetary grants and recognition
98awards to public and private persons and organizations and to
99subsidize efforts to reduce energy consumption and raise
100awareness of alternative energy-efficiency practices.
101 b. Up to 25 percent to fund education and outreach
102programs that publicize renewable energy solutions for
103households and businesses and educate home and business owners
104about the environmental and financial benefits of innovative
105green technologies and practices.
106 c. Up to 25 percent to fund educational programs and
107materials that emphasize sustainable development practices,
108including recycling, energy efficiency and consumption, and
109other green practices.
110 (71) PRESERVING THE PAST LICENSE PLATES.-
111 (a) The department shall develop a Preserving the Past
112license plate as provided in this section. The plate must bear
113the colors and design approved by the department. The word
114"Florida" must appear at the top of the plate, and the words
115"Preserving the Past" must appear at the bottom of the plate.
116 (b) The annual use fees shall be distributed to the Toomey
117Foundation for the Natural Sciences, Inc., which shall retain 50
118percent of the proceeds until the startup costs to develop and
119establish the plates have been recovered. Thereafter, the
120proceeds shall be used as follows:
121 1. A maximum of 10 percent of the proceeds may be used to
122fund the administrative, promotion, and marketing costs of the
123license plate program and the foundation.
124 2. The remaining fees shall be used by the foundation to
125acquire, manage, and preserve properties that are of scientific
126importance to paleontologists, archeologists, or geologists for
127the purposes of research and education and to promote and
128protect the unique natural sciences of this state.
129 (72) PEACE LICENSE PLATES.-
130 (a) The department shall develop a Peace license plate as
131provided in this section. The plate must bear the colors and
132design approved by the department. The word "Florida" must
133appear at the top of the plate, and the words "Sunshine State"
134must appear at the bottom of the plate.
135 (b) The annual use fees shall be distributed to the Toomey
136Foundation for the Natural Sciences, Inc., which shall retain 50
137percent of the proceeds until the startup costs to develop and
138establish the plates have been recovered. Thereafter, the
139proceeds shall be used as follows:
140 1. A maximum of 10 percent of the proceeds may be used to
141fund the administrative, promotion, and marketing costs of the
142license plate program and the foundation.
143 2. The remaining fees shall be used by the foundation to
144support educational, research, and scientific activities in this
145state, including the distribution of funds to qualified entities
146in furtherance of the stated purposes of the foundation.
147 Section 3. This act shall take effect October 1, 2010.
