2 An act relating to eligibility for appointment as a
3 medical or clinic director; amending s. 400.9905,
4 F.S.; revising the definition of the term “medical
5 director”; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (5) of section 400.9905, Florida
10 Statutes, is amended to read:
11 400.9905 Definitions.—
12 (5) “Medical director” means:
13 (a) A physician who is employed or under contract with a
14 clinic and who maintains a full and unencumbered physician
15 license in accordance with chapter 458, chapter 459, chapter
16 460, or chapter 461; or
17 (b) An advanced registered nurse practitioner who is
18 employed or under contract with a clinic, who maintains a full
19 and unencumbered license to practice professional nursing in
20 accordance with chapter 464, and who is certified in advanced or
21 specialized nursing practice in accordance with chapter 464.

23 If a However, if the clinic does not provide services pursuant
24 to any of the respective physician or nurse practices acts
25 specified listed in this subsection, it may appoint a Florida
26 licensed health care practitioner who does not provide services
27 pursuant to those the respective physician practices acts listed
28 in this subsection to serve as a clinic director who is
29 responsible for the clinic’s activities. A health care
30 practitioner may not serve as the clinic director if the
31 services provided at the clinic are beyond the scope of that
32 practitioner’s license; however, except that a licensee
33 specified in s. 456.053(3)(b) who provides only services
34 authorized under that paragraph pursuant to s. 456.053(3)(b) may
35 serve as clinic director of an entity providing such services as
36 specified in s. 456.053(3)(b).
37 Section 2. This act shall take effect July 1, 2017.
