Florida Senate - 2011 CS for SB 318 By the Committee on Judiciary; and Senator Siplin 590-03802-11 2011318c1 1 A bill to be entitled 2 An act relating to postsecondary student fees; 3 creating s. 1009.215, F.S.; providing an exemption 4 from payment of nonresident tuition at a state 5 university or a Florida College System institution for 6 a student who meets specified requirements; requiring 7 the Board of Governors of the State University System 8 to adopt regulations and the State Board of Education 9 to adopt rules; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 1009.215, Florida Statutes, is created 14 to read: 15 1009.215 Nonresident tuition exemption.— 16 (1) Beginning with the 2011 fall term, a student, other 17 than a nonimmigrant alien within the meaning of 8 U.S.C. s. 18 1101(a)(15), is exempt from paying nonresident tuition at a 19 state university or a Florida College System institution if the 20 student meets all of the following requirements: 21 (a) Attended high school in the state for 3 or more years, 22 which need not be consecutive. 23 (b) Graduated from a high school in the state or attained a 24 high school equivalency diploma pursuant to s. 1003.435. 25 (c) Registered as an entering student or is currently 26 enrolled at a state university or a Florida College System 27 institution. 28 (d) In the case of a student without lawful immigration 29 status, files an affidavit with the state university or the 30 Florida College System institution stating that the student has 31 filed an application to legalize his or her immigration status 32 or will file an application as soon as he or she is eligible to 33 do so. 34 (2) The Board of Governors shall adopt regulations and the 35 State Board of Education shall adopt rules to implement the 36 nonresident tuition exemption provided in this section. 37 Section 2. This act shall take effect July 1, 2011.
