1 A bill to be entitled
2 An act relating to proceeds funding motorcycle safety
3 education; amending s. 320.08, F.S.; requiring a
4 portion of Highway Safety Operating Trust Fund
5 proceeds to fund a motorcycle driver improvement
6 program administered by a specified nonprofit entity;
7 providing program requirements; requiring a report to
8 the Legislature; amending s. 322.025, F.S.; conforming
9 provisions to changes made by the act; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraph (c) of subsection (1) of section
15 320.08, Florida Statutes, is amended to read:
16 320.08 License taxes.—Except as otherwise provided herein,
17 there are hereby levied and imposed annual license taxes for the
18 operation of motor vehicles, mopeds, tri-vehicles as defined in
19 s. 316.003, and mobile homes as defined in s. 320.01, which
20 shall be paid to and collected by the department or its agent
21 upon the registration or renewal of registration of the
22 following:
23 (1) MOTORCYCLES AND MOPEDS.—
24 (c) Upon registration of a motorcycle, motor-driven cycle,
25 or moped, in addition to the license taxes specified in this
26 subsection, a nonrefundable motorcycle safety education fee in
27 the amount of $2.50 shall be paid. The proceeds of such
28 additional fee shall be deposited in the Highway Safety
29 Operating Trust Fund and shall be distributed as follows:
30 1. One dollar shall be paid quarterly to ABATE of Florida,
31 Inc., a nonprofit corporation, to fund a grassroots motorcycle
32 driver improvement program consisting of activities administered
33 by ABATE of Florida, Inc., to increase awareness for all drivers
34 and motorcycle safety for motorcycle operators. ABATE of
35 Florida, Inc., may use pamphlets, outdoor advertising, and
36 personal contact with the public to enhance motorcycle awareness
37 and safety. ABATE of Florida, Inc., shall file an annual report
38 with the President of the Senate and the Speaker of the House of
39 Representatives outlining the types of activities ABATE of
40 Florida, Inc., conducted and stating the number of individuals
41 who had exposure to the materials.
42 2. The remaining $1.50 shall be used to fund a motorcycle
43 driver improvement program implemented pursuant to s. 322.025,
44 the Florida Motorcycle Safety Education Program established in
45 s. 322.0255, or the general operations of the department.
46 Section 2. Section 322.025, Florida Statutes, is amended to
47 read:
48 322.025 Driver improvement.—The department may implement
49 programs to improve the driving ability of the drivers of this
50 state. Such programs may include, but shall not be limited to,
51 safety awareness campaigns, driver training, and licensing
52 improvement. Motorcycle driver improvement programs implemented
53 pursuant to this section or s. 322.0255 may be funded by the
54 portion of the motorcycle safety education fee collected
55 pursuant to s. 320.08(1)(c)2. s. 320.08(1)(c), which shall be
56 deposited in the Highway Safety Operating Trust Fund.
57 Section 3. This act shall take effect July 1, 2023.
