    1                        A bill to be entitled                      
    2         An act relating to infectious disease control;
    3         requiring the Department of Health to convene a task
    4         force to evaluate activities related to antibiotic
    5         resistant bacteria; specifying appointments; providing
    6         duties and responsibilities of the task force;
    7         requiring the task force to submit a report, an action
    8         plan, and recommendations to the Governor, the
    9         President of the Senate, and the Speaker of the House
   10         of Representatives; amending s. 400.141, F.S.;
   11         revising the type of pneumococcal vaccine given to
   12         nursing home residents; deleting obsolete language;
   13         providing an effective date.
   14          
   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. The Department of Health shall convene a task
   18  force to evaluate and make recommendations related to the
   19  efficacy of state surveillance, mandatory reporting, public
   20  notification, prevention, and response activities related to
   21  antibiotic-resistant bacteria. The task force must include, at a
   22  minimum, representatives of facilities licensed under chapter
   23  395, chapter 400, and part I of chapter 483, Florida Statutes;
   24  health care practitioners licensed under chapter 458, chapter
   25  459, chapter 464, and chapter 474, Florida Statutes; a
   26  representative from the Agency for Health Care Administration;
   27  and a representative from the Department of Health. At least two
   28  members of the task force must be certified infection control
   29  practitioners. Members of the task force may be reimbursed for
   30  travel expenses. The task force shall evaluate the list of
   31  currently reportable antibiotic-resistant bacteria; reporting
   32  procedures, including content and format of the reports;
   33  notification procedures, including the modes and the network of
   34  distribution; and response procedures, including coordination
   35  with other departments and agencies of state government, county
   36  and municipal governments, school boards, the Centers for
   37  Disease Control and Prevention, facilities that may be affected
   38  by an outbreak, and the public. The task force may evaluate
   39  other issues it deems necessary and appropriate. The task force
   40  shall submit a report of its findings and an action plan for
   41  implementation, together with any recommendations of necessary
   42  legislation, to the Governor, the President of the Senate, and
   43  the Speaker of the House of Representatives no later than July
   44  1, 2015.
   45         Section 2. Paragraph (t) of subsection (1) of section
   46  400.141, Florida Statutes, is amended to read:
   47         400.141 Administration and management of nursing home
   48  facilities.—
   49         (1) Every licensed facility shall comply with all
   50  applicable standards and rules of the agency and shall:
   51         (t) Assess all residents within 5 working days after
   52  admission for eligibility for pneumococcal polysaccharide
   53  vaccination or revaccination (PPV) and vaccinate residents when
   54  indicated within 60 days after the effective date of this act in
   55  accordance with the recommendations of the United States Centers
   56  for Disease Control and Prevention, subject to exemptions for
   57  medical contraindications and religious or personal beliefs.
   58  Residents admitted after the effective date of this act shall be
   59  assessed within 5 working days of admission and, when indicated,
   60  vaccinated within 60 days in accordance with the recommendations
   61  of the United States Centers for Disease Control and Prevention,
   62  subject to exemptions for medical contraindications and
   63  religious or personal beliefs. Immunization shall not be
   64  provided to any resident who provides documentation that he or
   65  she has been immunized as required by this paragraph. This
   66  paragraph does not prohibit a resident from receiving the
   67  immunization from his or her personal physician if he or she so
   68  chooses. A resident who chooses to receive the immunization from
   69  his or her personal physician shall provide proof of
   70  immunization to the facility. The agency may adopt and enforce
   71  any rules necessary to comply with or implement this paragraph.
   72         Section 3. This act shall take effect July 1, 2014.
