A BILL FOR AN ACT

 

 

relating to elections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  (a)  The office of elections shall develop and implement a statewide voting modernization program that shall:

     (1)  Apply to all elections, as that term is defined in section 11-302, Hawaii Revised Statutes, held in the State beginning in 2018;

     (2)  Provide registered voters with the option to vote by cellular phone; and

     (3)  Provide voter education materials relating to the voting by cellular phone program.

     (b)  In implementing the program, the office of elections shall:

     (1)  Ensure that voter privacy and the integrity of the elections process are upheld;

     (2)  Ensure that each individual who is eligible to vote by cellular phone is able to do so;

     (3)  Ensure that the identity and place of residence of a voter may be verified with regard to the ownership or use of a specific cellular phone or cellular phone number, whether by affidavit or other prescribed means; and

     (4)  Create forms, implement procedures, and adopt rules pursuant to chapter 91 to support the purposes described in paragraphs (1) through (3).

     SECTION 2.  No later than twenty days prior to the convening of the regular session of 2016, the office of elections shall submit a report to the legislature that includes:

     (1)  The current status of the implementation of the voter modernization program;

     (2)  A brief description of any operational problems or legal impediments that have affected or are anticipated to affect implementation of the program;

     (3)  Any proposed legislation to aid in the implementation of the program; and

     (4)  Any cost projections necessary to implement the program.

     SECTION 3.  This Act shall take effect upon its approval.
