A BILL FOR AN ACT

 

 

relating to law enforcement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 52D-5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§52D-5[]]  Powers of chief of police; outside own county[.]; on state land beneath bridges and viaducts.   The chief of police of each county and any duly authorized subordinates shall have and may exercise all powers, privileges, and authority necessary to enforce the laws of the State[, in]:

     (1)  In a county other than the county in and for which the chief has been appointed, if:

     [(1)] (A) The exercise of such power, privilege, and authority is required in the pursuit of any investigation commenced within the county in and for which the chief has been appointed; and

     [(2)] (B) The concurrence of the chief of police of the county in which the power, privilege, and authority sought to be exercised is obtained[.]; and

     (2)  Notwithstanding any law to the contrary, on any state land located beneath any bridge or viaduct that is located within the county under the chief of police's jurisdiction."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
