A BILL FOR AN ACT
RELATING TO DISCRIMINATION IN REAL PROPERTY TRANSACTIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to clarify the definition of "familial status" in the law pertaining to discrimination in real property transactions to specify that a non‑parent individual cohabiting with any minor children must have evidence of legitimate consent of the child's parent to qualify for "familial status".
SECTION 2. Section 515-2, Hawaii Revised Statutes, is amended by amending the definition of "familial status" to read as follows:
""Familial status" means the status of:
(1) [a] A parent having legal
custody of and [domiciled] cohabiting with a minor child or
children[, a];
(2) A person who is [domiciled] cohabiting
with a minor child or children and who [has written or unwritten] possesses
evidence of legitimate permission [from] of the legal parent[,
a];
(3) A person who is pregnant[,];
or
(4) [any] A person cohabiting
with a minor child or children and who is in the process of securing the
legal custody of [a minor] the child or children.
For purposes of determining familial status, "evidence of legitimate permission" means consent that is genuine and authentic, and not fabricated for purposes of subverting the law."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
