A BILL FOR AN ACT

 

 

relating to administrative rules.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that many administrative rules that were adopted by agencies of the executive branch of the State were authorized by statutes that have been superseded or preempted by federal law.  While those agencies should be repealing rules that are based on statutory authority that is no longer effective, the legislature further finds that executive agencies have sometimes been less than willing to devote the resources needed to repeal obsolete rules.

     Accordingly, the purpose of this Act is to convene a task force, to be attached to the office of the lieutenant governor for administrative purposes, to review existing administrative rules and to recommend the repeal of rules that are based on statutory authority that is no longer effective.

     SECTION 2.  (a)  There is established within the office of the lieutenant governor for administrative purposes a state administrative rules review task force.

     (b)  The task force, without regard to the public notice or public hearing requirements of chapter 91, Hawaii Revised Statutes, shall:

     (1)  Review existing administrative rules of the State;

     (2)  Determine which rules are no longer authorized by statute; and

     (3)  Recommend the repeal of all administrative rules that are no longer authorized by statute.

     (c)  The following individuals or their designees shall serve as members of the task force:

     (1)  Three members who shall be appointed by the governor to represent the interests of executive branch agencies;

     (2)  The chief justice of the supreme court;

     (3)  The president of the small business regulatory review board; and

     (4)  An expert in administrative law who shall be appointed by the governor.

     (d)  The Chamber of Commerce of Hawaii shall also be invited to designate one member to serve on the task force.

     (e)  The members of the task force shall elect a chairperson from among themselves.

     (f)  The task force members shall not be compensated but shall be reimbursed for necessary expenses incurred, including travel expenses, in carrying out their duties.  The office of the lieutenant governor shall provide all necessary administrative, professional, technical, and clerical support required by the task force.

     (g)  The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2017.

     (h)  The task force shall be dissolved on June 30, 2017.

     SECTION 3.  This Act shall take effect on July 1, 2016.
