A BILL FOR AN ACT

 

 

relating to the contractors license board.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that under the current system, general contractors may hold seats for specialty contractor positions on the contractors license board, which may unnecessarily risk public safety.

     The purpose of this Act is to better protect the public by amending the membership of the contractors license board to ensure that specialty contractors and the public are adequately represented on the board and to establish residency and domiciliary requirements for membership on the board.

     SECTION2 .  Section 444-3, Hawaii Revised Statutes, is amended to read as follows:

     "§444-3  Contractors license board.  (a)  There shall be a contractors license board of [thirteen] fifteen members[.], each of whom shall have been a resident of and domiciled in the State for not less than five years preceding the member's appointment.

     (b)  Of the board members:

     (1)  [Ten] Eight shall be contractors who have been actively engaged in the contracting business in the State for a period of not less than five years preceding the date of their appointment[;] and who shall each hold a valid and unexpired license to operate as a contractor at the time of the appointment.  Of the eight contractors appointed, two shall be general engineering contractors, two shall be general building contractors, and four shall be specialty contractors who do not hold a general engineering or general building contractor license;

    [(2)  Five shall be general engineering or building contractors, five shall be specialty contractors, and three shall be noncontractors.  No member shall receive any compensation for the member's services, but each shall be reimbursed for necessary traveling expenses incurred in the performance of duties.]

     (2)  Seven shall be public members who at the time of their appointment do not hold a valid or unexpired license to operate as a contractor, are not relatives of any board member who holds a contractor's license, and do not have a financial interest in the business of any board member possessing a contractor's license.  For the purposes of this paragraph, "relative" means a spouse, fiancé, fiancée, parent, sibling, child, or anyone who is related to a contractor member within two degrees of consanguinuity.

     (c)  Each county shall be represented on the board.

     (d)  [No one, except the three noncontractor members, shall be eligible for appointment who does not at the time of the member's appointment hold a valid and unexpired license to operate as a contractor.] Board members shall not receive compensation for their services but shall be reimbursed for necessary travel expenses incurred in the performance of their duties.

     (e)  Violation of section 444-17, Hawaii Revised Statutes, shall be grounds for removal from the board.

     (f)  For the purposes of this section, the terms "general engineering contractor", "general building contractor", and "specialty contractor" have the same meaning as in section 444-7."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval; provided that members currently serving on the contractors license board shall continue to serve on the board until the expiration of their current term.
