A BILL FOR AN ACT
RELATING TO DEPARTMENT OF EDUCATION FUNDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that in recognition of the current economic recession and budget deficit, it will be difficult to allocate additional funds to the department of education over and above the amount allocated in the General Appropriations Act of 2009.
The legislature is considering other initiatives that would restructure Hawaii's educational system for purposes of ensuring that the department of education operates efficiently and effectively, while promoting student growth and achievement. As a result, the board of education should be given additional flexibility in using the existing funds to carry out such restructuring.
The purpose of this Act is to allow existing funds that have been appropriated to the department of education to be reprioritized and redistributed as necessary, without affecting weighted student formula funds.
SECTION 2. Part III, Act 162, Session Laws of Hawaii 2009, is amended by adding a new section to read as follows:
"SECTION 41.1. Provided that the department of education may reprioritize and redistribute any funds that have been appropriated as deemed necessary and appropriate to implement restructuring efforts; provided that:
(1) Weighted student formula funds shall not be reduced below the amounts in effect as of July 1, 2010; and
(2) The department of education shall submit a report to the legislature of all the uses of this proviso no later than twenty days prior to the convening of the 2011 and 2012 regular sessions."
SECTION 3. This Act shall take effect upon its approval.
