A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established a peer-to-peer regulatory task force located in the department of commerce and consumer affairs for administrative purposes to consist of the following members:

     (1)  A representative from the department of transportation;

     (2)  A representative from the department of commerce and consumer affairs' insurance division;

     (3)  A representative from the department of commerce and consumer affairs' office of consumer protection;

     (4)  Two representatives from rental car companies operating in the State, to be selected by the department of commerce and consumer affairs;

     (5)  Two representatives from insurance companies operating in the State, to be selected by the department of commerce and consumer affairs; and

     (6)  Two representatives from peer-to-peer motor vehicle sharing companies operating in the State, to be selected by the department of commerce and consumer affairs.

     (b)  The director of commerce and consumer affairs or the director's designee shall chair the task force.

     (c)  The purpose of the task force is to develop proposed legislation for the regulation of peer-to-peer motor vehicle sharing companies and to identify any potential issues currently unaddressed by state law.  The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020.

     (d)  The task force shall serve until it has accomplished the purpose of this Act or twenty days prior to the convening of the regular session of 2020, whichever occurs first.

     (e)  No member of the task force shall be made subject to section 84-17, Hawaii Revised Statutes, solely because of that member's participation on the task force.  The task force shall be exempt from chapter 92, Hawaii Revised Statutes.

     SECTION 2.  This Act shall take effect on July 1, 2019.
