A BILL FOR AN ACT

 

 

relating to corrections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the frequent use of sick leave by corrections officers costs taxpayers millions of dollars each year.  Overtime costs are triggered when corrections officers take sick leave because replacement officers must be called in or asked to work a double shift.  The additional costs can be expensive because corrections officers, as government workers, are entitled to twenty-one days of sick leave annually, with additional family and medical leave available for eligible corrections officers to care for an immediate family member with a serious health condition or for the officer's own illness.  The cost of overtime at the Oahu community correctional center was $2,600,000 for fiscal year 2013 and $3,200,000 for fiscal year 2012.

     The purpose of this Act is to improve the management of overtime costs at state correctional facilities by requiring corrections officers to work at least forty hours per week to qualify for overtime compensation.

     SECTION 2.  Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§78-     Corrections officers; overtime compensation.  A corrections officer, as defined in section 88-21, employed in any correctional facility administered by the department of public safety shall be entitled to overtime compensation only for work performed in excess of forty hours in each work week."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval; provided that section 2 of this Act shall apply to collective bargaining agreements executed after the effective date of this Act.
