A BILL FOR AN ACT

 

 

RELATING TO THE COUNTIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§46-    Planning and permitting fines; discounts prohibited.  (a)  Notwithstanding any other law to the contrary, a county shall not authorize or accept a discounted payment of a fine levied by the county department or agency that administers planning and permitting.

     (b)  Any ordinance or rule that conflicts with subsection (a) shall be void.

     (c)  As used in this section, "discounted payment" means a payment that is less than the full amount of a levied fine, but does not include partial payments if the full amount remains due."

     SECTION 2.  (a)  The state auditor shall conduct an annual audit of the fines assessed and collected by the county department or agency that administers planning and permitting.

     (b)  The state auditor shall submit a report of its findings and recommendations, including any proposed legislation to the legislature no later than twenty days prior to the convening of each regular session of the legislature.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2030.

Description:

Prohibits a county from accepting a discounted payment of a fine levied by the county planning and permitting department or agency.  Requires the State Auditor to conduct an annual audit of the fines levied and collected by the counties.  (HB460 HD1)
