A BILL FOR AN ACT
RELATING to urine free zones.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the public has a right to the enjoyment of public places free of the smell or presence of urine or feces. Public places to be designated as urine free zones include public playgrounds and those areas related to public transportation. The establishment of urine free zones in these areas will help protect the public from health hazards that stem from human waste, as well as enable Hawaii residents and visitors to freely utilize and enjoy public spaces.
The purpose of this Act is to protect public health and maintain public order by establishing public "urine free zones" where the act of urinating or defecating is prohibited.
SECTION 2. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Urinating
or defecating in a urine free zone.
(1) A person commits the offense
of urinating or defecating in a urine free zone if the person intentionally
urinates or defecates in a public place designated by this section as a urine free
zone.
(2) The following public places are designated as
urine free zones:
(a) Public
playgrounds and public playground equipment;
(b) Public bus
stops;
(c) Public park and
ride facilities;
(d) Public parking
lots; and
(e) Public parking
garages, including the structures' stairwells.
(3) Urinating or defecating in a urine free zone
is a
violation punishable as follows:
(a) For a first
offense, by a fine of not more than $500;
(b) For a second
offense, by a fine of not more than $1,000;
(c) For a third or
subsequent offense, by a fine of not more than $2,000.
(4) Any person who commits the violation of
urinating or defecating in a urine free zone shall, at the discretion of the
sentencing authority, have the option to complete a court approved drug,
alcohol, or mental health treatment program in lieu of paying fines
mandated by this section."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
