A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii's visitor drowning rate is thirteen times the national average and nearly ten times the rate of Hawaii residents from 2003 to 2012, with snorkeling by far the most common activity in which a fatal accident occurs.  The legislature also finds that in 2003 to 2012, one-hundred two visitors drowned while snorkeling compared to thirteen residents.

     The legislature further finds that it is essential to provide as much information on concerns with snorkeling to Hawaii's visitors and residents to address the significant fatalities associated with snorkeling in Hawaiian waters.

     The purpose of this Act is to develop and provide adequate information to visitors and residents regarding the dangers of snorkeling.

     SECTION 2.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§200-    Snorkel; safety checklist.  (a)  No person or store shall rent or sell a snorkel without attaching a warning checklist on the snorkel.

     (b)  The department shall adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 3000.
