HOUSE CONCURRENT

RESOLUTION

 

 

urging the BOARD of land and natural resources to appoint harbor agents as enforcement officers for the purposes of enforcing parking violations at small boat harbors in the State.

 

 

 


     WHEREAS, there is a reoccurring issue with limited parking at the State's small boat harbors, most notably Lahaina Harbor; and

 

     WHEREAS, vehicles with permits are allowed to park in small boat harbors, but there are often a number of vehicles parked without applicable permits; and

 

     WHEREAS, there have been reports that commercial entities at small boat harbors have allowed their customers to illegally park in permit-only stalls; and

 

     WHEREAS, people will risk receiving a citation and deliberately park illegally due to the nominal fee for an entire day at the waterfront; and

 

     WHEREAS, citations do not serve as a deterrent to illegal parking because of the economic benefit derived from illegal parking; and

 

     WHEREAS, under existing law, only conservation and resource officers can enforce parking violations in small boat harbors; and

 

     WHEREAS, a shortage of conservation and resource officers has led to a lack of enforcement of parking rules in small boat harbors; and

 

     WHEREAS, the Board of Land and Natural Resources is authorized under section 199-4, Hawaii Revised Statutes, to appoint and commission enforcement officers who can enforce parking violations at small boat harbors; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, the Senate concurring, that the Board of Land and Natural Resources is urged to appoint harbor agents as enforcement officers, as authorized under section 199-4, Hawaii Revised Statutes, for purposes of enforcing parking violations at small boat harbors in the State; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to Chairperson of the Board of Land and Natural Resources.
