A BILL FOR AN ACT
RELATING TO HEALTH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The department of health and department of human services shall develop and adopt rules, policies, and plan amendments necessary to ensure that the state medicaid program covers medically necessary services, including applied behavior analysis services, for individuals aged twenty—one and older with neurodevelopmental disorders, including autism spectrum disorder.
SECTION 2. The department of health and department of human services shall apply for any necessary approvals from the Centers for Medicare and Medicaid Services to amend the state medicaid plan to provide reimbursements for medically necessary services, including applied behavior analysis services to medicaid-eligible persons over the age of twenty-one diagnosed with an autism spectrum disorder.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the department of health and department of human services to develop and adopt rules, policies, and plan amendments necessary to ensure that the state medicaid program covers medically necessary services, including applied behavior analysis services, for individuals aged twenty—one and older with neurodevelopmental disorders, including autism spectrum disorder.
The sums appropriated shall be expended by the department of human services for the purposes of this Act.
SECTION 4. This Act shall take effect upon its approval.
