A BILL FOR AN ACT
RELATING TO FANTASY COMPETITIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 712-1220, Hawaii Revised Statutes, is amended as follows:
1. By adding a new definition to be appropriately inserted and to read:
""Fantasy competition" means any online fantasy or simulated game or contest such as fantasy sports, online, or otherwise, in which:
(1) Participants own, manage, or coach imaginary teams;
(2) All prizes and awards offered to winning participants are established and made known to participants in advance of the game or contest;
(3) The winning outcome of the game or contest reflects the relative skill of the participants and is determined by statistics generated by actual individuals such as players or teams, in the case of a professional sport; and
(4) No winning outcome is based upon:
(A) Only the performance of an individual athlete; or
(B) The score, point spread, or performances of any single real-world team or a combination of any real-world teams."
2. By amending the definition of "contest of chance" to read:
""Contest of chance" means any contest, game, gaming scheme, fantasy competition, or gaming device in which the outcome depends in a material degree upon an element of chance, notwithstanding that skill of the contestants may also be a factor therein."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on January 1, 2017.
