A BILL FOR AN ACT

 

 

Relating to patient-centered medical homeS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that uncoordinated health care is associated with duplicate procedures, conflicting treatment recommendations, unnecessary hospitalizations and nursing home placements, and adverse drug reactions.  In addition to these problems, there are also issues regarding the patient's ability to access a primary care physician, inadequate physician payment, use of unnecessarily expensive medical services, and poor care management for patients with chronic health conditions.  The legislature also finds that the concept of the "medical home" provides a helpful approach to addressing these problems.

     The purpose of this Act is to define and establish "patient-centered medical homes"; encourage licensed health care providers and patients to partner in the patient-centered medical home; define quality standards that will reduce disparities in health care access, delivery, and health care outcomes; and improve the overall quality of health care and lower the costs therein.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

PATIENT-CENTERED MEDICAL HOME ACT

     §   -1  Declaration of Purpose.  The purpose of this chapter is to encourage licensed health care providers and patients to partner in patient-centered medical homes; define and encourage adherence to quality standards that will reduce disparities in health care access, delivery, and outcomes; and improve the quality and lower the cost of health care.

     §   -2  Definitions.  As used in this chapter, unless the context clearly requires otherwise:

     "Patient-centered medical home" means a health care delivery model in which:

     (1)  Individual patients have an ongoing relationship with a physician or other licensed health care provider acting within the provider's scope of practice, who is trained to provide first contact and continuous and comprehensive care, or if appropriate, provide referrals to health care professionals that provide continuous and comprehensive care;

     (2)  A team of individuals at the practice level collectively take responsibility for the ongoing health care of patients by providing for all of a patient's health care needs or appropriately making referrals or arrangements for health care by other qualified health care professionals; and

     (3)  Care is coordinated and integrated across all elements of the complex health care system, including mental health and substance use disorder care, and the patient's community, and care is facilitated, if available, by registries, information technology, health information exchanges, and other means to ensure that patients receive the indicated care when and where they need and want the care in a culturally and linguistically appropriate manner.

     §   -3  Patient-centered medical home; duties.  The patient-centered medical home shall:

     (1)  Advocate for its patients;

     (2)  Utilize evidence-based medicine and clinical decision support tools to guide decision making;

     (3)  Utilize licensed health care providers who accept accountability for continuous quality improvement through voluntary engagement in performance measurement;

     (4)  Seek patients' feedback and encourage active participation in decision making to ensure that the patients' expectations are being met;

     (5)  Utilize information technology appropriately;

     (6)  Participate in a voluntary recognition process conducted by an appropriate nongovernmental entity to demonstrate that the practice has the capabilities to provide patient-centered services consistent with the medical home model;

     (7)  Allow patients and families to participate in quality improvement activities at the practice level; and

     (8)  Provide enhanced access to health care through systems such as open scheduling, expanded hours, and new options for communication between the patient, the patient's personal provider, and practice staff.

     §   -4  Limitations.  This chapter shall in no way be construed to:

     (1)  Permit a medical home to engage in or otherwise aid and abet in the unlicensed practice of medicine, either directly or indirectly;

     (2)  Change the scope of practice of physicians and surgeons, nurse practitioners, or other health care providers;

     (3)  Affect the ability of a nurse to operate under standard procedures pursuant to chapter 457;

     (4)  Apply to activities of managed care plans, or their contracting providers, or county alternative models of care, or their contracting providers, or local coverage expansion and enrollment demonstration projects, if those activities are part of established demonstration projects, as specified; or

     (5)  Prevent or limit participation in activities authorized by sections 2703, 3024, and 3502 of the federal Patient Protection and Affordable Care Act (Public Law 111-148), as amended by the federal Health Care and Education Reconciliation Act of 2010 (Public Law 111-152), if the participation is consistent with state law pertaining to the scope of practice."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2012-2013 for qualified patient-centered medical homes as certified by the office of the governor's healthcare transformation coordinator or leadership team.

     The sum appropriated shall be expended by the office of the governor for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2012.
