A BILL FOR AN ACT
relating to towing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 200-14, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) Any person who violates any rule adopted by
the department under this part regulating vehicular parking or traffic movement
shall have committed a traffic infraction as set forth in chapter 291D, the
adjudication of which shall be subject to the provisions contained
therein. A person found to have
committed [such a] the traffic infraction shall be fined not more
than:
(1) $100 for a first violation;
(2) $200 for a second violation; and
(3) $500 for a third or subsequent violation[.];
provided that no vehicle operated by a person found to have committed a traffic infraction pursuant to this section, while parked in a designated parking stall, shall be towed away unless a citation was issued no less than twenty-four hours before the towing."
SECTION 2. Section 290-11, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a)
Notwithstanding any other provision of this chapter, any vehicle left
unattended on private or public property without authorization of the owner or
occupant of the property, may be towed away at the expense of the vehicle
owner, by order of the owner, occupant, or person in charge of the property;
provided that there is posted a notice prohibiting vehicles to park on the
property without authorization[.]; provided further that no vehicle
parked without authorization in a designated public parking stall shall be
towed away from any land owned or operated by the State unless a citation was
issued no less than three hours before the towing.
The notice shall clearly state, in not less than two-inch high, light reflective letters on a contrasting background, that the vehicle parked without authorization will be towed and held at the expense of the vehicle owner, as well as the name, address, and a telephone number of the facility where the vehicle will be towed and held. The notice shall be of such size and be placed in a location that is clearly visible to the driver of a vehicle approaching any individual marked or unmarked parking space; provided that where an entire parking lot consists of restricted parking spaces, placement of the notice at each entrance of the parking lot shall suffice.
The fine for a citation issued for a vehicle parked without authorization shall be no more than $100."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.

Provides that the Department of Land and Natural Resources Division of Boating and Ocean Recreation shall not tow vehicles operated by persons found to have committed certain traffic infractions unless a citation was issued no less than 24 hours before the towing. Provides that a vehicle parked without authorization on land owned or operated by the State shall not be towed without first being issued a citation no less than 3 hours before the towing. Provides that the citation shall not be more than $100.
