A BILL FOR AN ACT
RELATING TO DATA COLLECTION.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 846, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§846- Systems
of identification; gender identity information. (a) In addition to identifying information collected
on persons pursuant to section 846-2.5, beginning January 1, 2023, the gender identity
of persons for whom identifying information is kept pursuant to section 846-2.5
shall be included in the systems of identification, if disclosed. The data center shall collect the following gender
identity designations and terminologies:
(1) Male;
(2) Female;
(3) Transgender women/female;
(4) Transgender man/male;
and
(5) Non-binary.
(b) Gender identity information collected
pursuant to this section shall remain confidential and shall be used strictly
for statistical research and data analysis, as authorized by section
846-2.5(d).
(c) For
purposes of this section:
"Gender identity" means an
individual's sense of being male, female, transgender, or another gender, as distinct
from the individual’s sex assigned at birth."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 30, 2075.
