A BILL FOR AN ACT

 

 

relating to recordkeeping.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 481X, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part   .  Internet Service Providers

     §481X-    Definitions.  As used in this part:

     "Internet protocol address" means a numerical label assigned to each device participating in a computer network that uses the internet protocol for communication and provides host or network interface identification and location addressing.

     "Internet service provider" means a company that provides access to the Internet.

     §481X-    Recordkeeping requirements for internet service providers.  Any internet service provider that provides internet service to a consumer in the State shall retain consumer records for no less than two years.  The required data for the consumer records shall include each subscriber's information and internet destination history information.  Destination information shall include any of the following:

     (1)  Internet protocol address;

     (2)  Domain name; or

     (3)  Host name."

     SECTION 2.  Chapter 481X, Hawaii Revised Statutes, is amended by designating sections 481X-1 to 481X-12 as part I, entitled "General Provisions".

     SECTION 3.  This Act shall take effect upon its approval.
