A BILL FOR AN ACT

relating to the definition of property.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.  Section 708-800, Hawaii Revised Statutes, is amended as follows:

""Property" means any money, personal property, real property, thing in action, evidence of debt or contract, or article of value of any kind[.], and includes intellectual property and property that is stored in an electronic medium and is retrievable in a perceivable form.  Commodities of a public utility nature such as gas, electricity, steam, and water constitute property, but the supplying of such a commodity to premises from an outside source by means of wires, pipes, conduits, or other equipment shall be deemed a rendition of a service rather than a sale or delivery of property."

SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.
